Ownership is
a complex juristic concept,which has its origin in the ancient Roman law.Perhaps
of all the rights, rights to ownership is the most important right.The earlier
legal systems did not recognize the distinction between ownership and
possession. The concept of ownership developedmuch later than possession. The
term`Ownership’ was used in EnglishLaw,for the first time in 1583, when it was
distingushied from possession.
The subject
matter of ownership explain right to one person.Many juristic give definition
of ownership in their own way Austin Defined Ownership as a right which
avails against every one who is subject to the law conferring the right to put
thing to user of indefinite
nature. but it has many critism on the other hand Salmond Defined that “Ownership in its most
comprehensive significant denotes the relation between a person and a right
that is vested in him.” So we see that salmond want to say that ownership
is the relation to right and person and also his possession .
It denotes
control over material object
In another sense ownership implies an aggregate ofal
those rights vested in a person, which can use against others .
